VIVHO Sp. z o.o. ("VIVHO") warrants to the individual or entity (the "Owner") that any VIVHO product (the "Product") which has been obtained from VIVHO or VIVHO's authorized dealer will be free from any defects in materials and workmanship under normal use for one (1) year from the date of purchase (the "Warranty Period").
If the Product proves defective during the Warranty Period you must follow the instructions set out below for returning the Product, and VIVHO will inspect the Product, and at its sole option and subject to applicable laws: either (a) repair the Product using either new or refurbished parts, or (b) replace the Product with a new or refurbished product that is the same or equivalent to the Product you purchased.
A replacement Product assumes the remaining warranty of the original Product, or 30 days from the date of replacement, whichever is longer.
To obtain warranty service on the Product purchased directly from VIVHO, contact VIVHO Customer Support. VIVHO is not responsible for items damaged or lost in transit.
VIVHO reserves the right to decide whether to replace the Product or repair the defect. If the defect is confirmed, after replacement or repair we send back the Product to you at our cost.
VIVHO covers the product for the Warranty Period as long as proof of purchase can be provided.
This warranty policy does not apply to, and specifically excludes, the following: (a) normal wear and tear and cosmetic damage, including, but not limited to, scratches, dents and broken plastic; (b) consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship in the Products; (c) defects or damage caused by misuse, accident (including, without limitation, collision, fire and the spillage of food or liquid), neglect, abuse, alteration, unusual stress, modification, improper or unauthorized repair, installation, wiring, or testing, improper storage, third-party applications downloaded to the Products or companion applications that connect to and communicate with the Products or if the serial number has been removed; (d) modifications of the Products firmware or software.
VIVHO does not warrant that the operation of the Product will be uninterrupted or error-free.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION. VIVHO'S RESPONSIBILITY FOR HARDWARE DEFECTS IS LIMITED TO REPAIR OR REPLACEMENT SERVICE AS DETERMINED BY VIVHO IN ITS SOLE DISCRETION. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN TIME TO THE TERM OF THIS LIMITED WARRANTY. ALL OTHER EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF NON-INFRINGEMENT, ARE DISCLAIMED. NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER THE EXPIRATION OF THE LIMITED WARRANTY PERIOD. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THIS LIMITATION MAY NOT APPLY TO YOU.
